Want to hear about and epic way to collect child support arrears? A few years ago I had a client, let’s call her Ginny, who was trying to collect a little over $13,000 in arrears. Following the break-up of their relationship, the deadbeat moved from the state where he had lived with her and their children to a state not too far away – only about 150 miles, but far enough that she couldn’t keep tabs on him for her money, if she needed to. I’m sure that was the plan, but that’s another story. Six months after he moved the modification motion arrived in the mail. He claimed that he no longer had the income that he once had and that he needed to have the child support order lowered substantially. He had completely stopped making payments, insisting that he could no longer afford them and already owed nearly $5000 in arrears. According to the paperwork that he filed with the courts, he went from earning $55,000 a year, to $10,000 a year. When my client appeared in court on the modification that her ex filed, her child support was lowered by about 80%. Ginny was devastated because she counted on the support money to help pay their daughter’s child care bill every month. Because her ex owned and operated a small social club – a mostly cash business – she did not know how to prove that he earned more than he reported. She knew his tricks all too well because he had played them when they were together as a couple – he claimed a certain amount for tax purposes and pocketed the rest.
After doing some digging and learning that her ex was still up to his old tricks and that in fact, it seemed like his social club was busier than ever after the relocation, Ginny decided that it was time for her to take some action into her own hands since CSE wasn’t doing much to help her. Ginny was a follower of the DontGetMadGetPaid methods and knew that a till-tap was an option for her. A till-tap allows a mom to have a sheriffs officer go directly into any place of business that has a cash register and remove cash from the “till” (the register itself) and give it to the mom as a child support payment.
Ginny completed and filed the proper paperwork, and waited by phone on the day that the till-tap was to be served. She was exhausted mentally, physically, emotionally and spiritually. She prayed that this would work. Finally, she received the call she waited for. It worked! The sheriff’s office called to tell her that the till-tap had been served and they collected over two thousand dollars in cash from her ex’s till at the club.
The best part about the story is that her ex was uh – upset. He had been embarrassed in front of his customers and had a lot of explaining to do to his buddies who were at the club. He quickly made an agreement to settle up his arrears and stuck to it. Some months later, he agreed to increase his current child support payments.
