If your deadbeat ex receives an inheritance, generally speaking, if it is large enough, you should be able to have your child support increased. This is a state by state issue but all states have held that “income” derived from an estate (including inheritances) can be considered income for the purposes of child support. Income which comes as a result of the principal is different from the principal itself. The state in which you live determines whether you can have the principal considered or just the income which comes from the principal. If your state considers the principal, then you may in line for an increase in child support. If you need to collect arrears, all of the inheritance received is up for grabs.
