I love sharing stories of how moms worked around problems with their child support case and succeed when it otherwise seemed futile. There are always ways to solve a problem and sometimes if you hear how someone else solved their problem, you are better equipped to solve your own.
This is a great (and true) story when it comes to finding a creative way to serve a witness. This story is not my own, so I am not relaying first hand information. It comes to me by way of a colleague who is also engaged in a business which frequently requires serving legal documents upon people who try to shield themselves from situations like uh, – being served legal documents.
Apparently there was a fellow who had gone down a path of personal self-destruction. He owed bills up the wazoo, had a nasty drug habit that he was trying to kick but wasn’t having much luck kicking it and I don’t know everything about his personal financial information but he was also divorced with a gaggle of kids. If I had to take a guess I would say that under those conditions, he probably didn’t pay any support to his ex-wife and children, either. His ex-wife was not a client of mine so I cannot say for sure. Anyway, the guy was in hiding for the most part – hiding from bill collectors, hiding from the drug pushers to whom he owed money, hiding from a string of women he had scorned along the way since his divorce. Meanwhile, there was someone who was trying to dig up information on a third party for some legal purpose or another and Bobby had information he wanted. He hired a process server to serve Bobby with a subpoena, but Bobby couldn’t be found. Mr. Bobby Nothisrealname had done a great job of hiding himself but his parents were right out in broad daylight and it was assumed that his parents surely knew where their son was taking cover. Word had it that they were financially supporting him. It was decided that document server would subpoena Bobby’s parents in order to get to Bobby. Problem was that they lived in a huge house on a hill, completely surrounded by 10’ tall wrought iron gates, complete with snarling dogs and a Fort Knox security system.
After learning that Bobby’s parents were art collectors and were not able to pass up a great piece of art for their collections (addiction must run in the family gene pool), the server contacted the family secretary and informed her that he had a set of photographs which might help them to complete their collection of a famous rock star that they loved. A deal was made and the next day the server found himself driving through the big iron gates, past the dogs and straight up to the front of the house where he was greeted by Bobby’s parents. Rolling the window down, the server looked directly at Bobby’s father and asked him “are you Mr. Bobby Nothisrealname Sr.”? “Yes, I am” answered the gentleman. Handing him an envelope which contained the subpoena, the server says: “you have been served”. Mr. Nothisrealname already had firm grip on the envelope which he thought contained priceless photographs. The server jammed his car in reverse and backed all the way down the long driveway at full speed and took off.
